FAQS FOR EMPLOYERS OF FSG SOLDIERS

The following information is provided in order to assist FSG members and their Employers in navigating the service of FSG members.

For a full and comprehensive review of all rights/benefits associated with FSG membership please refer to Florida Statute 251.001(10)(a).

In accordance with F.S. 251.001(10)(a), all members of the Florida State Guard are entitled to certain protections in their employment while they are actively participating in training or activations with the FSG.

Florida Statute 250.48 - applies to Public employers/employees

​

  • Any employee of the state, county, city is entitled to a leave of absence without loss of pay, not to exceed 30 days.

  • This applies both to training such as IET or drilling periods and to any activations which the FSG member has received valid authorized orders for.

 

Florida Statute 250.481 – applies to Public and Private employers/employees

  • The FSG member may not be denied employment with a potential employer due to any obligation as a member of the FSG.

  • The FSG member shall not lose their job, or any promotion advantages because of their obligations as a member of the FSG.  

 

Florida Statute 250.4815 – applies to Public and Private employers/employees

  • If the FSG member holds a state license/certification of any kind, that license/certification cannot expire while the FSG member is actively participating in training or an activation for the FSG. 

 

Florida Statute 250.482  – applies to Public and Private employers/employees

  • FSG members may not be fired from their employment due solely to their absences relating to FSG activation/training.

  • FSG members must notify their employers as far in advance as possible of their intended absence AND of their intent to promptly return to work upon completion of their required activation/training.

  • FSG members are entitled to any seniority (time, service, etc.) that they would have attained during the period of training/activation had they physically been present at work. 

  • FSG members may be allowed to use any PTO, or other earned leave to cover the period of absence due to activation/training, but cannot be compelled to do so by their employer.

  • FSG members may bring civil action against their employers under this section.

 

Florida Statute 250.483  

  • FSG members who are seeking licensure or qualifications for a trade/occupation are entitled to certain protections if activation/training interferes with their period of training, study or apprenticeship for such licensure.
